I agreed in my divorce that I would refinance my home to get my former husband's name removed from the loan or it would be put up for sale, I was unaware that I could not assume my own loan. Nor did I realize that I would not qualify even though I have made every payment on time and with out penalties of any kind since the date he moved out.
The decree also states that he is no longer responsible for payments or repairs of any kind. I have done it solely on my own now for going on 3 years.
The day he moved out he left me with 5 days to come up with the entire mortgage payment on my own, and I did it by the grace of God, prayer and friends/clients.
I want to stay in the family home and he just wants his name off the loan. I have gotten nowhere fast with the banks and the ex. The bank is fine with collecting my money but says that their hands are tied and his name cannot and will not be removed.
I have custody of our 2 (minors) of our 4 children 50% of the time. If I sell my home I will be homeless. My mortgage is less than rent in our area. I do rent the back 2 rooms (an office and master bedroom to a senior friend of mine that I have known for 12 years now.
He lives in an apartment not far away. He can afford a 2 bedroom place by himself, I cannot.
the kids and I have 20 years of memories here and family pets buried in the yard. This is our home and we don't want to leave. Please Help! Even my children and neighbors are upset at the situation.
