Would you consider this a fair divorce settlement or am I being unreasonable?
Added (1). My husband and I have been married for 8 years, and we have a 4 year old daughter. I filed for divorce six months ago, and we have both been staying in the house until a settlement has been agreed apon. I really want to avoid a trial but I also don't want to be screwed.
I'm asking for 50% value of the equity of the house, for him to be responsible for our debt in return he can keep his pension, and a payout of 1/3 of the company. He pays me 1100 a month in child support.
Added (2). His idea for a settlement is: 50% of the house value, I'll be responsible for half the debt and. He'll pay me $500.00 spousal support a month for 4 years on top of child support. Note: He was in business 3 years before he met me, but his income has quadriplets since we've been married. He brings home after paying is employees, and other expenses 6500.00 net pay a month.
Added (3). I have a job, which I clear 2000 a month so I do have some income.
Added (4). In case anyone is confused. We no longer share a bank account, and we are legally separated even though we both live in the house. Hence while I'm collecting support.
Added (5). You can be legally separated and still living together. I had to prove to the courts I'm not finacially relying on him. I give him half the mortgage payment, and half the utilties, via a check, and he provides me with a copy of the bills for my records.
