Will I be liable for the new 3 percent stamp duty surcharge?

I already own a home with my ex but I haven't lived there for 6 years. My ex and kids live in the property so I am not in a position to sell it or come of the mortgage.

My main residence is a rental property that i have lived in for the past 5 years and I will be moving out of it when I buy my new house.
