Can a writ of execution be filed if an appeal has been filed on the case?
Hello everyone, I was recently In a civil case in pennsylvania that I lost and there was an order to pay X amount to the plaintiff, however I filed an appeal in a timely fashion which is now under consideration awaiting the judges approval for a hearing on said matter. I was just checking the court dockets online and noticed that the plaintiff filed a Praecipe for writ of execution and also a writ of execution with the Sheriff and Prothonotary a week ago. My question is a follows:
Can the above writs of execution be filed when the case has been appealed and is awaiting a hearing in the higher appellate court?
how can I fight or stop the process until my appeal is heard on the original case that this is all apart of?
can they seize my house if I have a mortgage?
dont I have to be served a copy of all of these documents before any sheriff comes nocking on my door to put a levy on my property.
what happens when a levy is placed upon my property to sell my interest in said items?
what can I do to protect my self from these writs of execution
