Has anyone in England and Wales got their property deposit back in the below situation?
On 25 February I viewed a property which was being sold at an auction the following day but I did not bid for it. The property was offered to me on 4 March for ã80000 and I needed to pay an ã8000 deposit. Having seen the property with a member of staff from Auction House London he told me that it was 30 metres squared in area I decided to pay the deposit. The property documents didn't have the area of the property but because it was a similar size to a 30 metres squared flat that I viewd I didn't think there would be a problem. After paying the deposit I was told to sign a contracts to complete by 31 March. I had agreement to get a mortgage from Nat West subject to a valuation. The valuation took place on 19 March and they found out that the flat was 24 square metres so they couldn't offer me a mortgage because it was less than 30 metres squared. I told Auction House London that they had misinformed me about the area of the flat therefore I couldn't complete.
They have refused to give me my deposit.
I have been to the police who sent me to the citizens advice bureau who told me to contact a conveyancey solicitor who couldn't help.
