Can I get my house deposit back?

Me and my now ex boyfriend bought a house together in October 2013, I paid the full deposit of £9700. We then later split in January 2015 and the house is due to complete its sale next Friday.
To start with I was advised that he is entitled to half of that deposit as I didn t get a declaration of some sort but is there not a loophole anywhere that because we lived together for a mere 1 year and 3 months he shouldn t be entitled to it?! As well as this he refused to pay his half of the mortgage from January till now so I ve been paying that solely. Am I at least entitled to that back?

The only other thing I can think of doing is tell the solicitor we can t agree on how to split the money so they hold onto it until we do?
