Should title serv co be responsible for not having surrendered title for previous manufactured home loan?


My father has a 1994 manufactured home purchased in 2006, we have been renting to own this. Now we are ready to refinance in our name, we cannot go through his loan company because it was originally financed through Wash Mu that is out of business and mortgage purchased by Chase. Chase will not do a new loan for a manufactured home. Now I am almost ready to get this done and my bank said I have to have a surrendered title for the manufactured home. I cannot find one, I have contacted the county Auditor, Treasurer and Title dept no one has anything. Now it will cost me $1300+ to create a new title. Can this expense fall back on the title service company that did the loan closing for my father?
