Well I just found out I'm getting sued. A good start to the day I must say. Basically I had a bank account and a mortgage that was automatically set up to come out of my checkings. Well in the small print it said that if my due date fell on either a holiday or weekend it would be processed first thing monday morning. Well they drafted my account the day before. This overdrafted my account. They tried to draft it 3 times at $35/each time. Then $7 a day there after. I contacted the BBB and they straightened it out so I could just close my bank account and keep my mortgage restarting where the draft originally started. That was in 2011. Now, 3 years later they are suing me saying I owe some of the fees that were due to this occurrence. But I was never notified of any additional money I was responsible for. It was settled through the BBB. What is the process aside from biting the bullet and paying what they say I owe. They have apparently started litigation so time is of the essence. Should I hire a lawyer or go to court? I'm so lost! :(
