Why does a bank get priority in a foreclosure over a child support lien if the cs debt is older then the mortgage.
Let's say a dad owes arrears with regards to child support for over 10 years. He buys a house (already owing back child support for a decade) and lives there for 10 more years still owing this debt. The house goes up for foreclosure, why does the bank have priority house before the child support lien given the cs debt was incurred before the mortgage?
