Mortgage Loan/Judgement-Need Release of Lien?
Trying to take out a mortgage loan, and a medical "judgment" from 2008 has popped up. I contacted the hospitals attorney and he said he no longer had the file, but if we wanted to settle the debt he could get it back. Well $15,000 is still to much, so I contacted the hospital to ask who has the case. They didn t say, but offered a settlement of $14,000. I told them that was still to much, and after negotiating they accepted my offer. Since we need a "release of lien" I asked would they be giving that to me and they said they will give me a letter of
"Settlement adjustment" I told them we want a "release of lien " she then said these are the steps:
1. We go in and pay
2. Wait for payment to clear/post, then she would send us letter of "settlement adjustment"
3. They then contact attorney to get "release of lien"
But she said it s a 2-3day process. Does that sound about right? Can they screw us over? Can the attorney refuse to give us a "release of lien"? Are these steps right?
